These Terms and Conditions govern access to and use of the site yatendi.com and the services provided by Yatendi, a product operated by Vitzi Tech LLC (hereinafter, "Yatendi" or "we").

Description of the service

Yatendi is an AI conversational agent service that operates over messaging channels (WhatsApp Business API, Instagram, web widgets, and others) to respond, capture leads, book appointments, and assist with customer service for small and medium-sized businesses. The specific scope of the service depends on the plan you subscribe to.

Account security

You are responsible for keeping your password confidential and for any activity that occurs under your account. Vitzi Tech LLC will not be liable if you share your password with third parties. We recommend that you change your password regularly and notify us immediately if you suspect unauthorized access.

Verification process

All interactions on this site, including subscriptions, payments, and the activation of channels such as WhatsApp Business, may be subject to a verification process. This may include confirming your identity, business ownership, or payment details, as applicable. In some cases, additional verification by email may be required.

License to use

Vitzi Tech LLC grants users a limited license to use the services and products offered on this site in accordance with these Terms and Conditions. This license is personal, non-transferable, and non-exclusive, and is granted while the subscribed plan is active and paid up.

Unauthorized use

Redistributing or reselling any content, modified or not, available on our site without our prior written consent is prohibited. This includes, but is not limited to, software, templates, agent prompts, and other digital products. Using Yatendi to send spam or illegal, fraudulent, discriminatory content, or content that violates the terms of WhatsApp, Meta, or other integrated platforms, is also prohibited.

Intellectual property rights

You may not claim intellectual property over any of the content provided, modified or not. All content is the property of its respective providers or creators. Unless expressly stated, products are delivered "as is" without express or implied warranties. Vitzi Tech LLC will not be liable for direct, indirect, incidental, special, or consequential damages arising from the use or inability to use our products.

The business data you upload to Yatendi (catalog, prices, FAQs, conversations with customers) remains your property. You grant us a non-exclusive license to process it for the sole purpose of providing the service you have subscribed to.

Payments, subscription, and cancellation

Plans are billed monthly in advance, in the currency and through the payment method indicated at the time of subscription. Failure to pay on time entitles Yatendi to suspend the service. You may cancel your subscription at any time from the dashboard or by writing to info@yatendi.com; cancellation takes effect at the end of the current billing period.

Third-party costs (for example, WhatsApp Cloud API conversations charged by Meta) may be billed separately or passed on to the customer, which will be detailed at the time of subscription.

Refund and warranty policy

Because these are digital products and intangible services, no refunds are issued once the service has been provided or the product delivered, unless the description does not match what was offered. Some products or services may carry specific warranties that will be detailed at the time of purchase. Warranties cover only defects in the service and apply provided the product or service has been used in accordance with the specifications provided.

Anti-fraud verification

Transactions may be temporarily delayed due to anti-fraud verification procedures. In some cases they may be suspended for further review to prevent fraud.

Service availability

We make reasonable efforts to keep Yatendi available 24/7, but the service may be affected by scheduled maintenance, third-party failures (WhatsApp, Meta, AI providers, AWS), or other events beyond our control. We do not guarantee uninterrupted availability and will not be liable for losses arising from service interruptions.

Privacy

Vitzi Tech LLC ensures the confidentiality of the personal information provided by users. Your personal data will not be shared with third parties without your consent, except as required by law. Governing law and jurisdiction

These Terms are governed by the laws of the State of Wyoming, United States of America. Any dispute arising in connection with them will be submitted to the competent courts of the State of Wyoming, waiving any other jurisdiction that may apply.

Changes to the terms and conditions

Vitzi Tech LLC reserves the right to modify these Terms and Conditions at any time without prior notice. We recommend reviewing this page periodically to stay informed of any changes. Continued use of the service after a change is published implies acceptance of the new terms.
